Terms of Service

1. Acceptance of Terms

By accessing and using Optimux ("the Service"), operated by Private Devops LTD, UIC 204791393, VAT BG204791393, registered in Bulgaria ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Service Description

Optimux provides server security auditing, infrastructure monitoring, uptime tracking, and compliance management services. Our platform includes a web dashboard and notification integrations (Email, Slack, Telegram, Discord, Webhooks) for managing your server infrastructure.

3. Accounts and Access

To use the Service, you must create an account and provide accurate information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Ensuring the servers you connect to the Service are owned or authorized by you

4. Acceptable Use

You agree to use the Service only for lawful purposes. You must not:

• Use the Service to scan or monitor servers you do not own or have authorization to manage
• Attempt to gain unauthorized access to other users' data or accounts
• Interfere with or disrupt the Service or its infrastructure
• Reverse-engineer or attempt to extract source code from the platform

5. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control.

6. Plans and Billing

Certain features are available only on paid plans. Pricing, plan limits, and billing cycles are described on our pricing page. We reserve the right to modify pricing with reasonable advance notice. Free tier users are not subject to billing but are limited to the features and capacity described in the Free plan.

6.1 Fair Use and Free Plan Limits

The Free plan is a limited tier. Critical and high severity vulnerability details, monitoring history beyond the last 24 hours, and delivery of alerts to non-email channels (such as Slack, Telegram, Discord, and webhooks) require a paid plan. Critical alerts still reach Free users by email, the in-app dashboard keeps working, and you can always see how many critical and high issues exist. Free accounts are limited to the server, monitor, and capacity counts shown on the pricing page, and each server IP address and each website domain may be monitored by only one account.

6.2 Abuse and Enforcement

You may not work around Free plan limits, for example by creating multiple accounts to monitor related infrastructure, or by using the API to bypass interface restrictions. We may suspend, pause, or limit accounts that abuse the Service, exceed fair use, or attempt to circumvent plan limits. Accounts that we administer directly for internal or managed clients are handled under separate arrangements and are not subject to the Free plan limits described above.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. All server data collected through the Service is treated as confidential and is strictly isolated between organizations.

8. Limitation of Liability

The Service is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Termination

Either party may terminate the agreement at any time. Upon termination, your access to the Service will cease and your data will be retained for 30 days before deletion, unless you request earlier removal.

10. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email or through the Service. Continued use after changes take effect constitutes acceptance of the updated terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Bulgaria. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Bulgaria.
